The claimant made a reference to the Upper Tribunal under the Electronic Communications Code ("the Code") asking the Tribunal to impose an agreement for access on the parties. The claimant sought access to the roof of one of the respondent's buildings in order to survey the building and investigate whether it may be a suitable location to site electronic communications apparatus. The respondent refused the claimant's request and accordingly, it was necessary to make a reference to the Tribunal in relation to the dispute.
