R. (on the application of Catt) v Brighton and Hove CC and Brighton and Hove Albion Football Club

This was an appeal against the judgment of Mr Justice Collins whereby he refused an application to quash a decision of Brighton and Hove CC (the Council) granting planning permission to Brighton and Hove Albion Football Club (the Club). The Club played football at Withdean Stadium (the Stadium), Brighton under a temporary planning permission. On February 14, 2005, an application for planning permission was made for the continued use of the Stadium until June 30, 2008, and for the provision of new stands and the extension of existing stands to provide an additional 1966 seats, increasing the capacity of the Stadium to about 9,000. Use of the Stadium by the Club was intended as a temporary measure until the Club obtained an alternative ground. The appellant lived in a cul-de-sac on the west side of the Stadium and suffered significant disturbance as a result of crowds attending football matches.
