This was an appeal against an order of Patterson J, refusing the appellant's application for permission to apply for judicial review of: (1) the decision of the Marine Management Organisation to grant a consent under the Brighton Marina Act 1968 ("the Act") s.24 for Phase 1 of the Outer Harbour development at Brighton Marina ("the development"); and (2) the actions of the first and second respondents in commencing Phase 1 of the development and thereafter proceeding with it.
