Defra issues guidance on statutory nuisance and the environmental permitting regime

Defra issued in March 2010 guidance on the relationship between the environmental permitting regulations and statutory nuisance powers exercised by local councils under the Environmental Protection Act 1990 (EPA 1990).rnIn particular this guidance advises on:rnlocal authority duties under Pt III of the EPA 1990;rn1. when and how the provisions of s.79(10) EPA 1990 apply;rn2. the need for good communication between the local authority and Environment Agency;rn3. the form and content of applications made by the local authority to the Secretary of State or Welsh Ministers; andrn4. indicative criteria on which applications will be determined.
