Die Bedeutung der Richtlinie 2005/29/EG über unlautere Geschäftspraktiken und ihre Auswirkungen für Lebensmittelrecht und Lebensmittelwirtschaft

The EC-Directive concerning unfair business-to-consumer commercial practices aims at a harmonisation of the legal regulations on unfair competition on the level of business-consumer-relations. The author analyses the impact of the implementation of this Directive upon food law in general and the advertisement of food products in particular. In this respect the author focuses on the advertisement of foods products addressed to minors, promotion measures, and recommendations by public organisations. The author arrives at the conclusion that the new Directive will not result in a tightening of the legal requirements already existing on the national level in Germany. However, the Directive puts a greater emphasis on the role of business association, by allowing them to issue authoritative instructions to their members.%Die Richtlinie über unlautere Geschäftspraktiken vom 11. Mai 2005 bezweckt die Harmonisierung des Rechts des unlauteren Wettbewerbs im Verhältnis von Unternehmer zu Verbraucher. Der nachfolgende Beitrag geht der Frage nach, welche Auswirkungen die Umsetzung der Richtlinie für die Anwendung des Lebensmittelrechts hat und welche Anforderungen künftig für die Werbung für Lebensmittel gelten.
