Conservation on the High Seas: Harmonizing International Regimes for the Sustainable Use of Living Resources

The conservation and management of marine living resources within areas beyond the limits of national jurisdiction remain one of the more contentious, problematic and multifaceted aspects of the modem law of the sea. Few circumstances better illustrate Garrett Hardin's celebrated 'Tragedy of the Commons' than the parlous current state of global fish stocks. Nevertheless, attempts to restrict the freedom of fishing on the high seas continue to run the gauntlet of one of the most jealously guarded principles of the law of the sea.
