The European Union's steelmakers plan to file a legal action against the European Commission requesting annulment of rules on the continued allocation of free carbon dioxide emission allowances to some industrial sectors under the EU Emissions Trading System (ETS) after 2012. The European Confederation of Iron and Steel Industries (known as EUROFER) said April 4 that it had decided to contest the Commission's so-called benchmarking decision, alleging that it infringed the ETS Directive (2009/29/EC) and would impose €5 billion ($7.1 billion) in additional costs on the industry between 2013 and 2020, the third phase of ETS.
