Evaluation of Electricity Liberalisation Legal Framework in Taiwan: What can we Learn from European Three Waves of Electricity Regulatory Reforms?

摘要

In the 1990s, Taiwan-affected by the trend of electricity liberalisation and by restructuring according to this change in the economic paradigm, as evidenced by the Public Utility Regulatory Policies Act (PURPA) of 1978 in the United States, the Electricity Act of 1989 in the United Kingdom, and legislation in other Organisation for Economic Co-operation and Development (OECD) countries-began to promote the idea of electricity liberalisation and privatisation. The purpose of this article is two-fold: (1) to contribute to the discussion of different waves of electricity liberalisation Bills (and the ideas they represent) from a legal perspective; and (2) to provide a more in-depth and critical review, particularly in light of Europe's experience with the two most important mechanisms of liberalisation-namely, unbundling and open access.
