In light of recent cases regarding ownership of inventions and copyright, universities may not necessarily own all registrable designs that they might consider to be "created in the course of employment".This article considers the test for ownership of inventions created by employees under the Designs Act 2003 (Cth) {Designs Act) and its UK equivalent, and the applicability of the ownership principles relating to patents as set out in University of Western Australia v Gray.
