The regulation of intellectual property protection requires a complex balancing act between rights holders and the public. Intellectual property law has vocal stakeholders, including rights holders, practitioners and academics. In resolving individual disputes, it is easy to lose sight of the larger questions: whether the positive effects of intellectual property outweigh the negative effects, and if not, how the system can be recalibrated to ensure that they do.
