It is an unfortunate truth that much of American law is the outcome of a political process. Statutory law, the law created by Congress and state legislatures, emerges from a political process involving representatives from multiple political parties and even broader political persuasions. The laws that are passed by these bodies are the end result of substantial debate, discussion, and give-and-take. Administrative regulations and regulatory processes may be somewhat less political, but because administrative leaders are political appointees, the end result can be a reflection of those appointments (as seen in the recent Net Neutrality debates). Perhaps court decisions are more balanced, but even so, many judges are either appointed by politicians or go through elections in which—even if they are nonpartisan—political influences can be a factor.
