Even for a remaining period of protection of only 17 days including weekends and public holidays, orders against an alleged infringer have to be taken in inter partes proceedings that can be scheduled ad hoc. Damages to the right owner resulting from an unlawful premature marketing of a generic drug are not "irreparable" but can be monetarily compensated.
