'IBM Japan'

In 1987, the plaintiff, who had worked for IBM Japan since 1983, made an invention that was granted a U.S. patent in 1991. Before the invention was filed in the U.S., the plaintiff assigned his right to obtain a patent to IBM Japan on 1 February 1989. HGST Japan, the defendant, was established on 25 December 2002 and took over the hard disk drive business from IBM Japan. On 1 January 2003, the plaintiff was transferred from IBM Japan to HGST Japan. After the plaintiff retired from work in March 2005, he filed a lawsuit against defendant, seeking a reasonable remuneration for his invention in the amount of US $1 billion.
