Question: Do you have to offer an accommodation to a disabled employee who doesn't ask? Answer: It depends on what part of the country you're in. A federal appeals court in New York has just ruled that an employer must accommodate employees whose disabilities are obvious - even if they don't seek an accommodation. But weeks earlier, another appeals court ruled in a Minnesota case that employers have no duty to accommodate employees who don't ask. In the New York case, the employee had cerebral palsy, and witnesses testified it was glaringly obvious he was disabled.
