No doubt a lot of thought went into it, and you may have had to fight for supporting budget.rnSo you'd probably be upset if an employee in some protected class who failed to win an award threatened to sue you for discrimination.rnNot that such an employee would be likely to win - a federal appeals court has just ruled that a manager's failure to nominate a black employee for a lucrative performance award didn't add up to an adverse employment action.
