The federal government is not subject to a statute of limitations in bringing a foreclosure action, the U.S. District Court for the Eastern District of New York ruled, dismissing the property owner's complaint that HUD's foreclosure was time-barred. (Long Island Realty Group VII v. U.S. Department of Housing and Urban Development, No. 03-CV-6105 (DRH), 2005 WL 2179687 (E.D.N.Y.), September 9, 2005) The plaintiff owner purchased the property subject to HUD's mortgage in or about 1983 and made its last mortgage payment in or about December 1989. In January 1991, HUD assigned the mortgage to R.F. Norman, who had a contract to carry out foreclosures for the department. According to HUD, the assignment was for collection purposes only.
