In the March 30,2012 decision, the district court concluded that Cemex was not entitled to summary judgment on the statute of limitations issue, as the limitations period can be tolled if it is found that the company concealed wrongdoing. However, the court granted Cemex summary judgment on EPA's claims that failure to obtain the contested preconstruction permits was also a violation of Tide V requirements.
