City Can't Ignore Conditions Placed On Demolition of Project Without Supplemental Environmental Review

The California Court of Appeal, Second District, Division 7, ruled that the city of Los Angeles could not ignore mitigating conditions it placed on the demolition of a multifamily project as part of the original environmental impact review (EIR) of the project without conducting a supplemental review. (Lincoln Place Tenants Association v. City of Los Angeles, Nos. B172979, B174028, 2005 WL 1635178 (Cal. App. 2 Dist.), July 13, 2005) In connection with the proposed demolition and redevelopment of Lincoln Place Apartments in Venice Beach, the city determined that the complex had limited historical and architectural significance and did not meet the criteria for preservation.
