San Jose Adopts Inclusionary Zoning Ordinance, Delays Implementation

The San Jose, Calif., city council has adopted a citywide inclusionary zoning ordinance that requires new housing developments to have 15 percent affordable units built on site or 20 percent built off site, but delayed implementation to allow for recovery of a depressed housing market.rnImplementation will be delayed until January 2013 unless construction permit activity recovers to benchmarks set in the ordinance.
