No Tax Credits Are Available For National Pool This Year

There will be no national pool for the allocation of unused low-income housing tax credits in 2010 for the first time since such allocations began in 1992. The Internal Revenue Service made the announcement in Notice 2010-74, which was issued October 28 and is scheduled appear in the November 15 Internal Revenue Bulletin. States have two years to use their annual credit allocations, and under Section 42(h)(3)(D) of the Internal Revenue Code, credits which aren't used in that period are returned for redistribution through the national pool to states which have allocated all of their credits.
