National Park Service Revises Historic Certification Procedures

The National Park Service (NPS) has revised its procedures for obtaining historic preservation certifications for the rehabilitation of historic structures. The certifications are needed to qualify for the historic rehab tax credit. Final regulations were published in the May 26 Federal Register. The NPS made no substantive changes in proposed rules published on October 15, 2010. (For background, see Current Developments, Vol. 38, No. CD-21, p. 653.) The rules eliminate the prohibition on appeals from the denial of preliminary certification for the rehabilitation of a property that isn't a certified historic structure. According to the NPS, this change conforms the regulations to longstanding agency practice, which has been to grant administrative review in such cases.
