The U.S. Fifth Circuit Court of Appeals in Inclusive Communities Project, Inc. v. Texas Dept of Housing and Community Affairs, 2014 WL 1257127 (5th Cir. 2014), adopted a three-step burden shifting legal standard for deciding disparate impact racial discrimination cases arising under the Federal Housing Act ("FHA"), 42 U.S.C.A. §§ 3604(a) and 3605(a). The court followed the guidance of the recent regulations issued by the U.S. Department of Housing and Urban Development ("HUD") at 24 C.F.R, § 100.500.
