In Fishing Rock Owners' Ass'n, Inc. v. Roberts, 2014 WL 1096246 (D. Or. 2014), involving a lawsuit brought by an Oregon homeowners' association to enforce covenants and restrictions prohibiting commercial activities the U.S. District Court for the District of Oregon granted a motion for summary judgment under Fed.RCiv.P. 56 to the homeowners' association on counterclaims alleging discrimination against persons with disabilities and retaliation that violated the federal Fair Housing Act ("FHA"), the Fair Housing Amendments Act ("FHAA") of 1988, and Or.Rev.Stat. § 659A.145.
