Bernstein v. Village of Wesley Hills, 2016 WL 1129182 (2d Cir. 2016), was a Second Circuit opinion affirming a decision by the U.S. District Court for the Southern District of New York which found that plaintiff members of a religious community failed to submit evidence of a claim of discrimination based on the filing of an action against their planned construction of an adult student housing complex by municipal officials.
