On July 23, HUD Secretary Ben Carson announced that the Department will ultimately terminate the Obama Administration's Affirmatively Furthering Fair Housing (AFFH) regulation, which was issued in 2015 and required communities receiving federal subsidies to analyze patterns of discrimination and racial segregation in housing in compliance with the 1968 Fair Housing Act, and then submit plans to correct any trends that were discovered. Secretary Carson has long contended that the AFFH rule was "complicated, costly, ineffective," and "a burden on communities." In 2018, HUD weakened the rule by indefinitely suspending the requirement that localities submit an Assessment of Fair Housing using the rule's Local Government Assessment Tool. "After reviewing thousands of comments on the proposed changes to the AFFH regulation, we found it to be unworkable and ultimately a waste of time for localities to comply with, too often resulting in funds being steered away from communities that need them most." said Secretary Carson.
