New DOT Rule Will Increase Hazardous Materials Transportation Security

In a May 5, 2003 interim final rule, the Research and Special Programs Administration (RSPA) of the U.S. Department of Transportation (DOT) has taken steps to enhance hazardous materials transportation security requirements (68 FR 23832-23842). The action incorporates several rules into the DOT Hazardous Materials Regulations (HMR), including Federal Motor Carrier Safety Administration (FMCSA), Department of Homeland Security Transportation Security Administration (TSA), and U.S. Coast Guard (USCG) standards that require shippers and transporters of certain hazardous materials to comply with federal security regulations. RSPA is also requiring applicants for HMR exemptions to comply with certification requirements. Inasmuch as the new requirements address essential security requirements, RSPA has determined that it is impractical and contrary to the public interest to issue a notice of proposed rulemaking and a public comment period. Therefore, the requirements were issued as an interim final rule that is effective immediately (i.e., on May 5, 2003). The compliance date is June 4, 2003.
