During World War Ⅱ, the Ford Motor Company built B-24 bombers for the U.S. government at Willow Run in Ypsilanti, Michigan. Fifty years later, Ford and other parties were found liable under CERCLA for cleanup costs at the site. In accordance with its War Contract, Ford sought reimbursement from the U.S. government; however, the U.S. Court of Federal Claims ruled that the government was not liable for the costs. Ford appealed the decision and, on August 10, 2004, the U.S. Court of Appeals for the Federal Circuit ruled that the U.S. government is liable for the cleanup costs incurred by Ford (Ford Motor Company v. United States, Docket Number: 03-5092).
