Site-Specific Risk Assessments for Hazardous Waste Combustors Upheld

The Cement Kiln Recycling Coalition (Coalition) is a trade association that includes manufacturers of Portland cement, and some of these facilities use hazardous waste as an alternative fuel in some kilns. In a July 13, 2007 decision, the U.S. Court of Appeals for the District of Columbia Circuit (DC Circuit Court) denied a petition brought by the Coalition to review the RCRA regulations that govern the permitting process for facilities that burn hazardous waste as fuel (Cement Kiln Recycling Coalition v. EPA, No. 06-1005, [D.C. Cir. July 13, 2007]). The appeals court also determined that the Coalition's challenge to a related guidance document was outside of its jurisdiction.
