The U.S. Court of Appeals for the Eighth Circuit has ruled that a district court erred as a matter of law when it imposed successor liability on a firm held responsible for part of the cleanup costs at a Superfund site (K.C. 1986 Limited Partnership ν. Reade Manufacturing, No. 05-2064 and No. 06-1944 [8th Cir., Jan. 4, 2007]). The U.S. District Court for the Western District of Missouri had ruled that DeAngelo Brothers Inc. was responsible for 15% of the $1.16 million needed to remediate the Armour Road Site in North Kansas City, Missouri.
