摘要

The article first critically evaluates the two exceptions to sculpture copyright under English copyright law; it shows, inter alia, that the word "permanently" in s.62 is riddled with ambiguities in respect of sculptures situated in premises open to the public, and argues that s. 62 be amended to include sculptures permanently situated in public only. Next, the article addresses the issue of moral rights germane to the two exceptions. Further, it evaluates the exceptions by looking at the laws of China and the United States. It concludes the discussion by urging amendment to the law.
