Retroactive liability for Superfund cleanups is shaping up to be one of the thorniest issues facing Congress in the last months of 1995. Demand is building from all quarters for Superfund reform, and House leadership has threatened to block Superfund spending unless a bill is passed. Two Superfund reform packages were put forward by House and Senate Republicans in September, both of which would ease liability for some potentially responsible parties (PRPs). Both proposals, however, fall short of the oft-stated goal of industry and many Republicans to totally repeal retroactive liability. In their compromise, both approaches acknowledge that the costs of full repeal appear too high.
