As of this writing in spring 2004, EPA is reviewing the recommendations of its Negotiated Rulemaking Committee regarding the planned "all appropriate inquiry" rule. The Agency anticipates issuing a proposed rule in the Federal Register sometime during summer 2004. At that time, EPA will establish a period of time for public comment on the proposal. In the interim, ASTM E 1527-00 continues to be the accepted standard of environmental due diligence for purposes of the CERCLA innocent landowner defense. Once finalized, the "all appropriate inquiry" rule will change the standard for future purchasers.
