Environmental adjudication in Kenya: a reflection on the early years of the Environment and Land Court of Kenya

The Environment and Land Court in Kenya is one of the newest and most advanced specialist environment courts in the world.This article outlines the historical evolution of the court, briefly explains its constitution, powers and jurisdiction, and highlights the important jurisprudence emerging from the court. It focuses in particular on some of the difficulties that the court has faced over the initial period of its existence and some of the continuing challenges. It concludes that the court has been well received by the Kenyan people, and is delivering on its constitutional mandate, but issues of resourcing and delineating the exact jurisdictional limits of the court remain.
