DESPITE RESOLUTION OF CASES, DOUBTS REMAIN ABOUT BUSH'S ENFORCEMENT RECORD

On March 18 of this year, the Depart merit of Justice (DOJ) and EPA announced that they and a handful of eastern states had reached a major settlement with Ohio Edison Company, a subsidiary of FirstEnergy Corp., resolving charges that the company had violated the New Source Review (NSR) provisions of the Clean Air Act (CAA) at the W.H. Sammis Station, a coal-fired electric power plant in Stratton, Ohio. Under the terms of the consent decree, the company has agreed to spend about $1.1 billion on the installation of state-of-the-art systems for controlling emissions of sulfur dioxide (SO_2) and nitrogen oxides (NO_X) at the Sammis plant and at three other Ohio Edison/FirstEnergy facilities.
