A Virginia state court Aug. 10 invalidated one of the permits for a coal-fired power plant that Dominion Resources Inc. has been building for more than a year (Appalachian Voices v. State Air Pollution Control Board, Va. Cir. Ct., No. CL08-3530, 8/10/09).rnThe permit for a maximum achievable control technology (MACT) was approved in 2008 by the State Air Pollution Control Board with an "escape hatch" clause saying that if the federal limits on mercury emissions "are not achievable on a consistent basis under reasonably foreseeable conditions, then testing and evaluation shall be conducted to determine an appropriate adjusted maximum achievable annual emission limit."
