11th Circuit Says Plan to Protect Sparrow In Everglades Will Not Jeopardize Hawks

A federal appeals court on May 5 upheld a U.S. Fish and Wildlife Service determination that a plan to protect a sparrow species from harm by an Everglades water diversion project will not jeopardize an endangered hawk, although the FWS must revise its explanation of when interagency consultations on the hawk are required (Miccosukee Tribe v. United States, 11th Cir., No. 08-10799, 5/5/09).
