Department of Natural Resources Ordered To Release Fracking-Related E-mails

An appeals court has ordered the Ohio Department of Natural Resources to provide e-mails regarding the disposal of fracking waste to a city and water treatment plant that had requested them under the state's public records law (Bott Law Grp. v. Ohio Dep't of Natural Res., Ohio Ct. App., No. 12AP-448, 11/26/13). The department "fell short of meeting its clear legal duty under R.C. 149.43(B)(1)" by not supplying all public records sought by the city of Warren and Patriot Water Treatment in a timely fashion, according to the Nov. 26 decision from the Ohio Court of Appeals for the 10th District.
