Advocates Challenge Water Quality Variance Granted to Iron Ore Processor in Minnesota

The Minnesota Center for Environmental Advocacy is challenging a variance to water quality standards in a Clean Water Act permit granted to Mesabi Nugget of St. Louis County, alleging that pollutants at the iron ore processing facility could be remediated (Minnesota Center for Environmental Advocacy v. EPA, D. Minn., No. 13-CV-1393, 6/10/13). The lawsuit, filed June 10 in U.S. District Court for the District of Minnesota, also said the variance, granted by the Minnesota Pollution Control Agency and approved by the U.S. Environmental Protection Agency in December 2012, violates the Administrative Procedure Act.
