A party opposing a consent decree regarding the Lower Fox River superfund litigation is not entitled to pretrial discovery of work product exchanged between Justice Department lawyers assigned to provide legal assistance to federal agencies with conflicting interests, the U.S. Court of Appeals for the Seventh Circuit has held (Menasha Corp. v. DOJ, 7th Cir., No. 12-1720, 2/20/13).
