A federal appeals court Jan. 31 again rejected a legal challenge brought by roadbuild-ers over the Environmental Protection Agency's approval of state regulations for nonroad engines, saying the case was filed too late (Am. Road & Transp. Builders Ass 'n v. EPA, D.C. Cir., No. 12-1243, 1/31/14). The U.S. Court of Appeals for the District of Columbia Circuit has now dismissed three related cases in recent years brought by the American Road & Transportation Builders Association, first in 2009, again in 2013 and now in 2014.
