Officials Ask EPA, Corps to Clarify Scope Of States' Responsibility Under Water Act

State water, wetlands and environmental officials want the Environmental Protection Agency and the U.S. Army Corps of Engineers to clarify the maximum extent of waters that states would assume responsibility for if they took over the federal dredge-and-fill permitting program under Section 404 of the Clean Water Act. In an April 30 letter to Nancy Stoner, EPA acting assistant administrator for water, the state officials asked the EPA and the corps to pursue a recommendation made in the joint proposed waters of the U.S. rule, which reads: "Clarification of waters that are subject to assumption by states or tribes or retention by the Corps could be made through a separate process under Section 404(g)."
