Part of Case Dismissed on Colo. Renewable Energy

A judge in the U.S. District Court for the District of Colorado dismissed four of six claims challenging the state's renewable energy standard, which requires utilities to derive at least 30 percent of their energy from renewable energy by 2020 (Energy and Env't Legal Inst. v. Epel, D. Colo., No. 11-859, 5/1/14). The court May 1 granted a motion for summary judgment filed by the Colorado Public Utilities Commission on the four claims, saying the plaintiff, the Energy and Environment Legal Institute, doesn't have standing to challenge the standard because it can't show injury. However, the court allowed the lawsuit to proceed on two remaining claims, saying the standard prevents Alpha Natural Resources Inc., a mining company and coal producer that is a member of the Energy and Environment Legal Institute, from competing for 30 percent of the energy market.
