The Environmental Protection Agency illegally attempted to fire an environmental scientist as retribution for speaking out about her belief that the agency downplayed health threats from the dust that blanketed parts of New York City following the Sept. 11, 2001, collapse of the World Trade Center, an administrative law judge has ruled. In addition, ALJ Linda S. Chapman ruled April 15 that the Environmental Protection Agency engaged in a deliberate effort to withhold 900-plus documents, such as e-mails, that should have been turned over to the scientist, Cate Jenkins, and her attorneys as they contested the dismissal. Chapman, a judge with the Department of Labor, criticized the EPA's performance, stating that the agency's withholding of evidence damaged its credibility. "The scope of the Respondent's [EPA] failure to provide the Complainant with the discovery to which she was entitled is breathtaking, to put it mildly," the judge wrote.
