摘要

The federal government and states remain at odds over which court-an appeals or district court-has exclusive jurisdiction to hear challenges to the Clean Water Rule, despite the fact that the U.S. Court of Appeals for the Sixth Circuit has claimed exclusive jurisdiction N. Dakota v. EPA, D.N.D., 15-00059, brief 4/11/16. The Justice Department, which is representing the Environmental Protection Agency and the U.S. Army Corps of Engineers, reiterated its earlier stance with the U.S. District Court for the District of North Dakota, saying the Sixth Circuit's decision to review multiple petitions challenging the water rule is binding nationwide (47 ER 774, 3/11/16).
