A federal district court in Minnesota will decide Aug. 5 whether to defer to the ruling by the U.S. Court of Appeals for the Sixth Circuit which held the appellate court as the proper venue to hear all lawsuits against the Clean Water Rule (Wash. Cattlemen's Ass'n v. EPA, D. Minn., No. 15-03058, brief 6/14/16). The U.S. District Court for the District of Minnesota was asked to postpone a pre-trial conference on the question of whether to proceed with reviewing the complaint against the water rule in a joint brief by a coalition of western cattlemen's groups and the Justice Department.
