Boston Edison Co. may continue to seek $40 million for the Department of Energy’s breach of a contract to dispose of spent nuclear fuel waste at a Massachusetts facility despite HoltecPilgrim LLC’s assertion the claims didn’t accrue before the facility was sold, a federal court said.The cost claims accrued before Boston Edison’s 1999 sale of the Pilgrim Nuclear Power Station because foundational elements of the breach claim were established when the departmentfirst breached the contract, Judge Charles F. Lettow of the U.S. Court of Federal Claims said in a Monday decision.
