Boston Edison Co. may sue the Department of Energy for breach of contract to dispose of spent nuclear fuel and nuclear waste at the Pilgrim Nuclear Power Station in Massachusetts because its claim over the decommissioned facility is concrete, the U.S. Court of Federal Claims said.Boston Edison, which seeks damages in excess of $40 million, saw its claim for fuel storage costs ripen when decommissioning of the facility began in May 2019, Judge Charles F. Lettow said in a decision issued Feb. 5, rejecting the U.S.'s standing arguments.
