Chinese Solar Power Cell Duties Must Be Reconsidered Once Again

U.S. duty rates on certain imports of solar power cells from China must be reconsidered once again, and possibly lowered, after a federal court on Wednesday took issue with how theCommerce Department calculated the value of an input used by Chinese manufacturers.The U.S. maintains antidumping duties on imports from China of “crystalline silicon photovoltaic cells, whether or not assembled into modules.” Commerce conducts periodicadministrative reviews of U.S. antidumping duties.In a review covering Chinese solar cells that entered the U.S. between December 2013 and November 2014, Commerce originally calculated dumping margins and corresponding dutyrates of 12.19% for Yingli Energy (China) Co. and 6.12% for Changzhou Trina Solar Energy Co. Other producers and exporters that proved their independence from the Chinesegovernment, but weren’t individually examined, received a margin of 8.52%, a weighted average of the two rates.
