The U.S. Supreme Court declined to revive a commerce clause challenge to federal protections forthe rare, spider-like Bone Cave harvestman, which lives only in Texas.The justices’ Monday decision means the court will sidestep the question as to whether federalregulation of the intrastate species under the Endangered Species Act exceeds Congress’ powerunder the commerce clause. The arachnids are known to only live in caves in Travis and Williamsoncounties in Texas.
