For the reasons set forth above, it is or- dered that defendant's motion to dismiss is denied as to count i of plaintiff's complaint. it is further ordered that this court declines to exercise supplemental jurisdiction over counts Ⅱ, Ⅲ, Ⅳ and Ⅴ of plaintiffs complaint and those counts are dis- missed without prejudice. it is so ordered.
